These Terms of Service ("Terms") govern your use of the Bunchi OS platform ("Service"), operated by Bunchi ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

The Service is a cloud-based restaurant and hospitality management platform that includes point-of-sale, kitchen display, ordering, catering, loyalty, and related tools.

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

The Service is offered on a subscription basis. Pricing details are available on our website. By subscribing, you agree to pay the applicable fees for your selected plan.

• Subscriptions are billed monthly unless otherwise stated.
• All fees are in British Pounds (GBP) and exclude VAT unless stated otherwise.
• Payment is processed securely via Stripe. We do not store your card details.
• Failed payments may result in temporary suspension of access until resolved.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.

We may offer a free trial period. During the trial, you have access to the Service at no charge. At the end of the trial, your subscription will begin unless you cancel beforehand. We will notify you before charging.

You retain ownership of all data you enter into the Service ("Your Data"). We do not claim any intellectual property rights over Your Data.

You grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service. We will not sell, share, or use Your Data for purposes other than operating the Service.

You are responsible for ensuring you have the right to upload any data, including customer information, in compliance with applicable data protection laws.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell or sublicense access to the Service without our written consent.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify you in advance of planned maintenance that may affect availability.

The Service, including its design, code, features, and branding, is owned by Bunchi and protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the Service under your subscription.

To the fullest extent permitted by law, Bunchi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold Bunchi harmless from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Either party may terminate these Terms at any time. You may cancel your subscription through the Service or by contacting us.

We may suspend or terminate your access if you breach these Terms, fail to pay fees, or if we reasonably believe your use poses a risk to the Service or other users.

Upon termination, you may request an export of Your Data within 30 days. After that period, we may delete Your Data in accordance with our data retention practices.

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
